TROUBLE IN THAILAND

In the middle of August (2010), I found a link to a dealer advertising buprestids from PNG with prices that turned out to be too good to be true. A quick reply to my request for a species and price list arrived and the dealing began. I selected the species and the number of specimens, paid the price and waited. At first I was told to send the money to the dealer’s wife in Thailand, but a day later, after I had sent it, I was told his wife was ill and couldn’t pick it up, so would I change the pickup name to his daughter, which I did. The next day I received messages from the dealer and a woman in Cameroun asking me to pay for “refundable insurance” which I was promised would be repaid once the parcel was delivered to me. I refused as it was already starting to seem fishy. After a number of excuses, the dealer told me that he would pay to have the shipment returned and then would find another shipping company. Two days later he asked me to pay for the shipment via EMS and asked me to send the payment not to him, but this time to the EMS agent in Bangkok. So this I did, since we never had agreed on who would pay the shipping. In the meantime I was being told that his friends were returning from PNG and might have additional specimens if I was interested. And he hoped that we could do much business in the future. But then after I paid the shipping charge, he told me that he had gotten that money from the EMS agent so that he could buy the extra specimens from his friends or else they would have sold them to someone else. He would make this up to me by including specimens from Malaysia, but could I pay him for the shipping again and he would send the parcel. This resulted in several days of a heated dispute, but stupid me, I wore out and sent the shipping money again, and again to the EMS agent. Then after two days the shipping agent told me that the parcel had been sent to London by mistake and was held in customs because the shipping documents and the wildlife permits were not correct. I needed to pay a fee to obtain a wildlife permit and get the shipping documents corrected so that all matched to clear both British and U.S. Customs. I refused, saying that it was the dealer’s problem to arrange such documentation and any change to Thai laws was their problem to know about and adapt to. Several further days of dispute, no involvement from the dealer who was reportedly gone to the forest to collect and couldn’t be contacted. As I continued to refuse to send anymore money, I was threatened by the EMS agent who would turn in the dealer to Thai authorities and report me to the FBI alleging that we were smuggling ivory out of Thailand and into the U.S. When I told him that I would welcome a visit from the FBI, he changed tactics and tried to pressure me by saying that if I didn’t pay to resolve the permits and documents that the London EMS office would just destroy the parcel and all of the specimens. I refused and reminded the agent and anyone else ‘listening’ that I had each and every email with all of the names of this masterful fraud and would be posting them to the internet to warn others off and perhaps just bring down their house of cards. Two weeks went by and my open letter to the dealer resulted in a “I’ve just returned, what is the problem”. When my reply was “you have my money, but you haven’t shipped my purchase”, silence again resulted. The most recent message told me that the dealer needs $300 to resolve the permit problem; I repeated the message “you have all of the money you will see from me until I have received the promised parcel.” It has now been nearly six weeks since my first payment and I suspect that this will not resolve in my favor, either with a refund or the belated arrival of the specimens I bought. So buyer(s) beware, below are the names, locations and several email addresses of the main players in this drama:

below are the chronological emails between Sapawan Yanthi from Thailand to me, Chuck Bellamy, about selling me Buprestidae from PNGthese are verbatim and not corrected to make me look better. I have all the original email messages should anyone be interested.

I strongly suggest that you avoid this person and never do any business with him and avoid the problems I have had with this crook of the first order!

I must not be making myself clear, I WILL NOT send any money to a separate party, either in Cameroon or elsewhere. This was never discussed in advance and IS NOT acceptable to me.

You must have many options for sending a parcel from Bangkok to the U.S., so please find another way.

There is NO complete assurance of refund to me, how can there be?

Retrieve the parcel from wherever it is now and send it via another carrier.

Since I am the customer, it should be my choice about the shipping. You have not answered my question about why you cannot use EMS!?

If you cannot do that, then please refund the money I have already paid to you.

i am very sorry about this mixeup. i put the blame on my daughter . i told her to go to the airport but she did wrong shipment .

i have contacted the delivery agency and i will probably retrieve back the shipment as tomorrow i will comong back to Bangkok and i will use the EMS. i think it takes 3 to 4 days arrival;

I am sensitive to such additions when they are not discussed from the beginning. And frankly, I am always over-cautious about things having to do with Africa. I've lived in Africa for 11 years and I know that things can go very badly there.
 
EMS or UPS is just fine with me.
 
I do not fully understand you saying "compensate for EMS cost". Have I not already paid you in full?

you are very correct . i lost some money to Africa to buy tarantula spiders for my Japanese customers. i am talking of EMS or UPS compensation meaning that i will add some species from Malaysia and my friends from PNG also called me they are coming to Bangkok tomorrow evening.so  i can wait for them and collect some species and add to your order. you know i have used the payment you gave in buying specimens here in Malaysia so i will be short of cash to do the registration of the shipment with UPS or EMS including the vet papers and customs fee here. i will talk to the manager tomorrow when i come back and inform you the cost and tell you how many pieces i will compensate you if you pay for the shipment.

you were including the cost of shipping in the total price I already paid.
 
I am not certain what you are meaning when you discuss adding Malaysian species, but now you mention 145 dollars for EMS.

What is going on?
 

If you were paying the shipment via air that would have required the refundable insurance, I would not have paid shipping costs for that
since you never mentioned any shipping charges at all.
 
One thing that I have not yet asked you: do each of the specimens that I have purchased have the location and date of collection information on them?
Are the specimens packaged separately or in groups? The scientific value of these specimens is only as high as the accurate information
about where and when they were collected.

i get your point. your payment was complete but because of this shipment failure i had to lose much money getting back the parcel today with extra charges and taxes.so i am suggesting that i am going to add some few  Malaysian specimens in the parcel before i send. also my friends fron PNG brought some more specimens . i can add if you wish.

all the specimens have indidual collection data including dates and places of capture. please tell me if you are ready for the payment and if you wish to have some more PNG specimens and we can calculate the total amount you have to send. i will prefer you send the money directly to the EMS officer and i will go there with the shipment. you know with EMS i have also to pay small money for vet papers and custom tickets.

I would prefer if you could investigate several alternatives to EMS: Thai post, UPS perhaps.
 
You have not indicated what Malaysian specimens you would add, so I cannot agree to that without knowing if this would be something of
interest to me or not.
 
Furthermore, I would possibly be interested in additional PNG specimens, but you have also not told me what specimens and prices are
possible. Can you send a list of what is available now.
 
I would prefer that we complete this first business transaction before we look to further cooperation. It would be good to have an agreed
routine that can be used again and again.

I sent the money to Mr. Djilo for my shipment. What he did with it is not my problem. You did not ask me to use that money, my money, in advance to buy
additional specimens from PNG, that was never part of this agreement.
 
I have paid you $525 for the beetles you offered at your prices but for one reason or another there is always another story, another
change of plan, or a decision made with my money but without my approval.
 
I want my money back if you are not going to send the specimens that I have already paid for. I will not send any more money until I receive
this first shipment.

i checked with the Custom Office. they will have to sign the customs papers only tomorrow when the offices are open . the wildlife office  has to get the documents tomorrow and do the change of ownership in your names and address .this  document from the wildlife office is very necessary for the delivery because the wildlife law has changed. the cost of having these 2 documents tomorrow is 298$. i have to pay for the documents in the wildlife office in Bangkok Customs office for the papers and do the faxing for delivery tomorrow.

i am near 1 am here now, i am preparing for the shipments i have to effect tomorrow. i dont have much time for that . if you are willing to get your shipment then i will get the papers tomorrow and do faxing. you get the shipment and later you can be asking Mr Sapawan when he comes from forest. i checked on the items and i have never seen beautiful itms from nature and he told me he got them from Papua New Guinea.

for the shipment to come back here will be time wasting and more expenditue because it will be re-dlivery.

i am from Belgium and i am working here now for 12 years haven worked in Hawaii in the US. so i try as much to just my work and do it well . i may have problem with the US officials if the papers are not produced for the delivery particularly the VET papers, it represents what they call in the US the CITES papers because some of the species maybe be protected species from PNG . ok??

however, no one explained this earlier, and I know of no reason to expect that any U.S. Customs official needs any payment…  so if you are telling me that it costs nearly $300 for Thai officials to prepare documents that should have been prepared before the shipment was sent, then I do not accept this.

I summarize what has happened up until now

here is how this has worked up until now:

I sent money to Mr. Sapawan’s wife, but then she becomes sick and I have to change to send it to his daughter.

His daughter tries to send the parcel via some strange shipping agent who suddenly wants $500 refundable insurance, which I refuse.

then he says that he will ship it via you but needs the price of the shipment, which he has me send to you. But then he tells me that he had you give him the money so that he could purchase more beetles for me with, although he didn’t mention this earlier nor ask my permission. Of course he needs me to send you the entire shipping payment again.

and now there is yet another delay because of this new, unknown change to the shipping rules, etc.

i am sure you will get clarification from the London office. they always insist particularly on the wildlife permit document . this is very important  as some specimens may be protected species and if Mr Sapawan does not know then this can lead you and even the delivery company into problems. its better you have at least the same document . thats what the London told me in the afternoon.

as for the customs vet papers i dont think its relevant as these insects are dried .

i will report you now to the royal thai police. i will tell them  that you and sapawan are  tracfficing elephant tusks with sapawan. i will give all your address and you be arrested by the fbi and sent to thailand prison. this is serious capital crime here.

I have been referred to your email address by an EMS agent (djilo dieudonne [djilodieudonne@hotmail.com]) in Thailand.

According to him a parcel was shipped to me from Thailand last week but was mislabeled with an address in Denmark and did not have the correct documents to allow a rescheduled delivery to my address in California.

Can you please verify any of this?

      you have  to understand that that most Asian dealers do a lot of trafficking without documents , so that is why the parcel entered UK without this documents .
  But we to advice that you better calm and do it the right way so that your parcel can be delivered to you in US .
   Once you provide us the documents , your parcel will be sent to you immediately .

you should calm down and get the story straight… first you will accuse me of wildlife trafficing and then you’re back to the wildlife papers.

you forget: I have done nothing wrong except for being too trusting.

I will gladly get the papers, but that is the responsibility of the shipper, so we can wait for Mr. Sapawan to fix his mistake.
